AURORA ENERGY ENTERPRISE PARTNERSHIP AGREEMENT 2005-2008

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by Aurora Energy Pty Ltd, The Association of Professional Engineers, Scientists and Managers, Australia, the Australian Municipal, Administrative, Clerical and Services Union, The Australian Workers' Union, Tasmania Branch, the Automotive Food, Metals, Engineering, Printing & Kindred Industries Union, and the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia, was for the purpose of filing an industrial agreement with the Commission.

[2] On 22 June 2005, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Tuesday, 12 July 2005 at 10.00 am.

[3] The agreement, to be known as the Aurora Energy Enterprise Partnership Agreement 2005-2008, is to be operative from the first full pay period on or after 1 May 2005 and it is to remain in force for a period of 3 years.

[5] Ms J Whittle for Aurora Energy Pty Ltd, Mr D Pyrke for The Association of Professional Engineers, Scientists and Managers, Australia, Mr C Dodds for the Australian Municipal, Administrative, Clerical and Services Union, Mr D Hanisch for the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union, Ms N Wells and Mr K Harkins for the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia and The Australian Workers' Union, Tasmania Branch, presented submissions in support of their consent application.

[6] Having considered the submission of the parties, I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
