LEGAL PRACTITIONERS AGREEMENT 2005

COMMISSIONER JP MCALPINE

HOBART, 13 September 2005

Industrial agreement - agreement approved - operative 1 July 2005 - to remain in force for a period of 3 years - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application was lodged, pursuant to Section 55 of the Industrial Relations Act 1984, by the Minister Administering the State Service Act 2000 and The Community and Public Sector Union (State Public Services Federation Tasmania) for the purpose of filing an agreement with the Commission.

[2] The agreement, to be known as the Legal Practitioners Agreement 2005, regulates certain employment conditions for Legal Practitioners, with particular reference to job classification structures and standards, increases in annual salaries and salary nexus arrangements and point-to-point translation.

[3] Mr P Baker for the Minister Administering the State Service Act 2000 and Mr M Di Pretoro, of The Community and Public Sector Union (State Public Services Federation Tasmania) presented submissions supporting approval of the agreement.

[4] The agreement is to be operative on and from 1 July 2005 and it is to remain in force for a period of 3 years.

[5] I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles. The agreement is approved, and I decide accordingly.

[6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
