REASONS FOR DECISION

[1] On 29 August 2005, the Minister Administering the State Service Act 2000 and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Radio Dispatch Operators (Department of Police and Public Safety) Agreement 2005.

[2] When this matter came on for hearing on 9 September 2005, Mr M Di Pretoro appeared for the CPSU, with Mr J McGuinness. Mr P Baker appeared for the Minister.

[3] Mr Baker submitted that this agreement builds on the current agreement1 applicable to the Radio Dispatch Services operation.

[4] The new agreement increases the shift allowance in line with the Police Award; modifies rostering provisions and clarifies overtime for part-time employees.

[5] Salary adjustments are consistent with the State Service Wages Agreement.

[6] Mr McGuinness outlined the history of negotiations and indicated the employees affected fully endorsed the agreement.

[7] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[8] Pursuant to s.55[4] of the Act, the agreement is approved operative from 1 March 2005 and shall remain in force until 1 March 2008.

[9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
