HOBART, 19 September 2005

Industrial Agreement - agreement approved - operative ffpp 16 September 2005 - for a period of three years - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by OneCare Limited (the employer) and the Health Services Union of Australia, Tasmania No. 1 Branch (the union), was for the purpose of filing an industrial agreement with the Commission.

[2] On 9 September 2005, the Commission convened a hearing at the Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence on Friday 16 September 2005 at 11.00 am.

[3] The agreement, to be known as the OneCare Limited (Personal and Home Based Care) Industrial Agreement 2005, is to be operative from the first full pay period to commence on or after 16 September 2005 and it is to remain in force for a period of three years.

[4] Mr M Vizard, appeared for the union and Ms S Gibson, for the employer.

[5] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.
