REASONS FOR DECISION
[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the National Union of Workers (Central Branch) (the union) and Statewide Independent Wholesalers Limited (the employer), was for the purpose of filing an industrial agreement with the Commission.
[2] A hearing commenced at the Supreme Court, Cameron Street, Launceston, Tasmania on Monday 17 October 2005.
[3] The agreement, to be known as the Statewide Independent Wholesalers Grocery Distribution Centre - NUW Redundancy Agreement 2005-2006, is to be operative on and from 1 October 2005 and it is to remain in force until 1 November 2006.
[4] The agreement applies to all employees of the company whether members of the Union or not, engaged in work under the classifications set out in the Statewide Independent Wholesalers Grocery Distribution Centre - National Union of Workers Enterprise Agreement 2004-2006 employed at the Prospect Distribution Centre.
[5] Oral submissions were presented by Mr B Bolitho for the union and by Ms J Squires for the employer.
[6] Having considered those submissions, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.
[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
