REASONS FOR DECISION

[1] On 12 October 2005, the Minister Administering the State Service Act 2000 (MASSA), The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch (LHMU) and the Tasmanian Correctional Officers Association (TCOA) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Correctional Officers Agreement 2005.

[2] When this matter came on for hearing on Friday 14 October 2005, Mr P Baker and Mr B Smith appeared for MASSA; Mr P Tullgren for LHMU; Mr P McGuire for TCOA; and, Mr M Johnston for CPSU.

[3] Mr Baker explained that the agreement was a consequence of extensive negotiations between the parties and reflected the transition from the existing gaol to the new complex, scheduled to come on stream in September 2006.

[4] The agreement created a formal nexus with salaries paid to correctional officers in other States and Territories, together with a mechanism for maintaining the nexus.

[5] With the exception of Utility Officers, the salaries agreement stands in the place of the Public Sector Unions Wages Agreement No. 2 of 2004.

[6] The agreement also reflects a move to a competency based career structure, a change in the management structure, and the concept of pre-paid overtime on a voluntary basis.

[7] Mr Tullgren and Mr Johnston endorsed the submissions of Mr Baker and urged that the agreement be approved.

[8] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[9] Pursuant to s.55(4) of the Act, the agreement is approved operative from 1 July 2005 and remains in force for a period of three years.

[10] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
