HOUSTON'S FARM (PROCESSING) INDUSTRIAL AGREEMENT 2005

REASONS FOR DECISION

[1] On 29 November 2005, The Australian Workers' Union, Tasmania Branch and Carrowdore Pty Ltd trading as Houston's Farm lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Houston's Farm (Processing) Industrial Agreement 2005.

[2] When this matter came on for hearing on 8 December 2005, Mr R Flanagan appeared for the AWU. Ms B Hazell appeared for Carrowdore Pty Ltd trading as Houston's Farm.

[3] Mr Flanagan explained that this agreement is to cover some 30 employees engaged in processing of fresh cut lettuce products. There is an existing agreement1, covering both farm and processing operations. It is intended that a separate agreement be negotiated for farm operations. However until that is finalised, the parties intend that the existing agreement remain on foot.

[4] The agreement provides for wage increases at 12-monthly intervals. It also contains a more detailed classification structure.

[5] Ms Hazell supported the submissions of Mr Flanagan.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.55(4) of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 28 June 2005 and shall remain in force for a period of three years.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
