REASONS FOR DECISION
(1) This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Tasmanian Catholic Education Employees' Association (the union) and the Tasmanian Chamber of Commerce and Industry Limited (on behalf of the employers), was for the purpose of filing an industrial agreement with the Commission.
(2) On 5 December 2005, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on 16 December 2005 at 9.10 am.
(3) The parties to the agreement are as follows:
Tasmanian Catholic Education Employees' Association The Archbishop of Hobart in respect of employees employed at the,
Catholic Education Office; MacKillop College; Mt Carmel College; and the schools listed in `Attachment A' of the agreement;
Dominic College Incorporated; Guilford Young College Incorporated; Sacred Heart College Incorporated; St Mary's College Incorporated; Marist Regional College Incorporated; The Provincial Council of the Christian Brothers - St Patrick's College - Australia (in respect of employees employed at St Virgil's College); The Governing Council St Patrick's College; and The Governing Council St Brendan-Shaw College.
(4) The agreement, to be known as the Tasmanian Catholic Education Salaries, Allowances and Conditions Industrial Agreement 2005, is to be operative on and from 31 December 2005 and will remain in force until 30 December 2008.
(5) Ms A Briant for the union and, Sr M Kelly for the employers respondent to the agreement, presented submissions in support of their consent application.
(6) Having considered the submission of the parties, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.
(7) The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
