Industrial Agreement - agreement approved - operative 8 October 2005 for a period of thirty six months - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union (the union) and Atlas Copco Australia Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Courthouse, 19 King Edward Street, Ulverstone, Tasmania on Tuesday 13 December 2005.

[3] The agreement, to be known as the Atlas Copco Australia Pty Limited (Burnie, Tasmania) Certified Agreement 2005, is to be operative on and from 8 October 2005 and it is to remain in force for a period of thirty six months.

[4] The agreement applies to all employees of Atlas Copco Australia Pty Limited, whether members of an organisation of employees or not, engaged in any of the occupations, industries or callings specified in the Metal and Engineering Industry Award.

[5] Oral submissions were presented by Mr S Littler of the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union and Mr M Breaden for Atlas Copco Australia Pty Ltd. Amendments were made to Clause 21 - Avoidance of Industrial Disputes.

[6] Having considered the submission, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
