REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by Hobart District Nursing Service Inc. (the employer) and the Health Services Union of Australia, Tasmania No. 1 Branch (the union), was for the purpose of filing an industrial agreement with the Commission.

[2] On 9 December 2005, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Thursday 15 December 2005 at 12.15 pm.

[3] The agreement, to be known as the Hobart District Nursing Service Inc. (Enterprise Bargaining) Industrial Agreement 2005, is to be operative from the first full pay period to commence on or after 19 December 2005 and it is to remain in force for a period of two years.

[4] Mr C Stringer appeared for the union and Ms N Green for the employer.

[5] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
