RETIREMENT BENEFITS FUND BOARD STAFF AGREEMENT 2005

Industrial agreement - agreement approved - operative 30 December 2005 - to remain in force for a period of 12 months - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application was lodged, pursuant to Section 55 of the Industrial Relations Act 1984, by the Retirement Benefits Fund Board and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. for the purpose of filing an agreement with the Commission.

[2] The agreement, to be known as the Retirement Benefits Fund Board Staff Agreement 2005, regulates certain employment arrangements for the following employees of the Retirement Benefits Fund Board. At Clause 7 - Employment Arrangements, it states:

 

"7.1

Employees who are:

· Continuing employees (full and part-time) employed pursuant to the Retirement Benefits Act 1993 (individual contract- no end date); and

· Limited-tenure employees (full and part-time) employed pursuant to the Retirement Benefits Act 1993 (individual contract- limited tenure).

7.2

Performance based contract employees (full and part-time - specified term) employed pursuant to the Retirement Benefits Act 1993."

[3] Mr R Rollins, Tasmanian Chamber of Commerce and Industry Limited with Ms A Dumas for the Retirement Benefits Fund Board, and Mr M Di Pretoro, of The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. presented submissions supporting approval of the agreement.

[4] The agreement is to be operative on and from 30 December 2005 and it is to remain in force for a period of 12 months.

[5] I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles. The agreement is approved, and I decide accordingly.

[6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
