REASONS FOR DECISION

[1] On 14 December 2005, the The Australian Workers' Union, Tasmania Branch and the Australian Mines and Metals Association (Incorporated) on behalf of Placerdome Asia Pacific trading as Henty Gold Limited, lodged with the Registrar, pursuant to Section 59 of the Industrial Relations Act 1984, an application to vary the Henty Gold Limited Enterprise Agreement 2004.1

[2] When this matter came on for hearing on 5 January 2006, Mr R Flanagan appeared for the AWU. Mr W Fitzgerald appeared for AMMA.

[3] Mr Flanagan explained that the purpose of this application was to remedy an error in Clause 16 - Annual Leave, relating to the accumulation of annual leave.

[4] Mr Fitzgerald supported the application.

[5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] Pursuant to s.59(2) of the Act, the variation to the agreement is approved operative from 19 September 2004.

[7] An Order giving effect to the variation is attached.
