REASONS FOR DECISION

[1] On 21 December 2005, an application was lodged by The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Community and Health Services (Public Sector) Award and the General Conditions of Employment Award.

[2] When this matter came on for hearing on 5 January 2006, Mr R Miller appeared for the CPSU, Mr T Kleyn appeared for the Health Services Union of Australia, Tasmania No. 1 Branch and Ms J Fitton appeared for the Minister Administering the State Service Act 2000.

[3] Mr Miller explained that the application sought to vary kilometreage allowances to reflect movements in the relevant CPI index. The formula for adjustment is consistent with the Full Bench decision in T33 of 1985, details of which are contained in the file.

[4] Mr Kleyn supported the submissions of Mr Miller.

[5] Correspondence from the CFMEU supported the application.

[6] Ms Fitton consented to the application.

[7] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[8] The application is granted operative from the beginning of the first pay period to commence on or after 5 January 2006.

[9] The Orders reflecting this decision are attached.
