REASONS FOR DECISION

[1] On 23 December 2005, the Health Services Union of Australia, Tasmania No. 1 Branch and St Ann's Homes Inc. lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the St Ann's Homes Inc. (Community Care) Industrial Agreement 2005.

[2] When this matter came on for hearing on 19 January 2006, Ms S Goldfinch appeared for the HSUA. Ms S Parr appeared for St Ann's Homes Inc.

[3] Ms Goldfinch explained that this agreement replaces the existing agreement approved on 1 April 2001.1

[4] The new agreement provides for minimum annual wage adjustments together with revised travel allowance arrangements.

[5] Ms Parr supported the submissions of Ms Goldfinch.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s55[4] of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 19 January 2006 and shall remain in force for a period of three years.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
