REASONS FOR DECISION

[1] On 17 January 2006, an application was lodged by the Police Association of Tasmania (PAT), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Police Award.

[2] When this matter came on for hearing on 16 February 2006, Mr M Kadziola appeared for the PAT, and Mr T Martin appeared for the Commissioner of Police.

[3] This application arises out of an earlier dispute notification concerning the application of the call out provisions in the Award.1

[4] The dispute was subject to an initial conciliation conference, which in turn led to a recommendation from the Commission dated 8 September 2005.

[5] Following extensive negotiations the parties reached an agreed position, which is reflected in the application to vary.

[6] In essence the variation means that officers who work overtime which is continuous with the normal commencement of a rostered shift, having been notified of the requirement to work either prior to or within two hours of finishing work, shall be paid for the hours so worked at the overtime rate. In all other cases the four-hour minimum call out shall apply.

[7] Mr Martin said that the variation met the operational requirements of the Department.

[8] The parties recorded on the transcript a number of understandings as to how the revised provisions shall apply.

[9] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[10] The application to vary is granted operative from 20 February 2006.

[11] The Order reflecting this variation is attached.
