REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the parties, was for the purpose of filing an industrial agreement with the Commission.

[2] On 23 January 2006, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Tuesday, 31 January 2006 at 9.15 am.

[3] By letter dated 30 January 2006, Mr L Hadley, for Inghams Enterprises Pty Ltd, informed the Commission that The Australian Workers' Union, Tasmania Branch would appear on its behalf in seeking approval of the agreement.

[4] The agreement, to be known as the Inghams Enterprises (Farming) Industrial Agreement 2005, is to be operative from the first full pay period on or after 31 January 2006 and it is to remain in force until 31 May 2007.

[5] The agreement shall apply exclusively to employees of the employer engaged in poultry farming, hatchery and feedmill operation in Tasmania.

[6] Mr R Flanagan for The Australian Workers' Union, Tasmania Branch and Inghams Enterprises Pty Ltd, presented submissions in support of the consent application.

[7] Having considered the submission of the parties, I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[8] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
