REASONS FOR DECISION
[1] On 20 January 2006, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch and VSL Australia Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the CFMEU and VSL Australia Pty Ltd Enterprise Agreement 2005-2008.
[2] When this matter came on for hearing on 24 January 2006, Mr W White appeared for the CFMEU and, with written authority, for VSL Australia Pty Ltd.
[3] Mr White explained that this agreement replaced an existing agreement registered under the Commonwealth legislation. The agreement provides for:
· Annual wage increments of 5%
· Enterprise allowance
· Flexibility of RDOs
· Redundancy payment
· Dispute settling mechanism
[4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.
[5] Pursuant to s.55(4), the agreement is approved operative from 19 January 2006 and shall remain in force until 15 October 2008.
[6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
