REASONS FOR DECISION
[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branch (the union) and Training and Recruitment Solutions (the employer), was for the purpose of filing an industrial agreement with the Commission.
[2] On 25 January 2006, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Wednesday, 8 February 2006 at 9.15 am. However, this was subsequently changed to Tuesday, 7 February 2006 at 10.45 am.
[3] The agreement, to be known as the AWU Training and Recruitment Solutions Silviculture and Afforestation Industrial Agreement 2005, is to be operative on and from 1 August 2005 and it is to remain in force until 1 August 2006.
[4] The agreement applies to all employees of the employer for whom a classification appears in this agreement.
[5] Mr R Flanagan appeared for the union and for the employer.
[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.
[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
