REASONS FOR DECISION

[1] On 1 February 2006, an application was lodged by the Australian Education Union (the AEU), Tasmanian Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Teaching Service (Tasmanian Public Sector) Award (the award).

[2] The application sought to vary expense related allowances, and in particular at Part IV - Allowances, Clause 9 - Required use of an Employee's Motor Vehicle of the award.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday, 15 February 2006 at 11.30 am.

[4] At the hearing Mr C Lane appeared for AEU, and Ms J Angel with Ms K Gunn, Industrial and Employee Services Human Resources Management, appeared for the Minister Administering the State Service Act 2000.

[5] Having heard the submissions of the parties, I am satisfied that the award should be varied as provided in the consent draft Order submitted by the AEU - Exhibit A.1.

[6] The award will be varied with an operative date on and from 15 February 2006. The variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[7] The Order giving effect to this Decision is attached.
