REASONS FOR DECISION
[1] On 3 February 2006, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU) and Stephen Little Constructions Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the CFMEU and Stephen Little Constructions Pty Ltd Enterprise Agreement 2005-2008.
[2] When this matter came on for hearing on 17 February 2006, Mr M Huxley appeared for the CFMEU and, with written authority, for Stephen Little Constructions Pty Ltd.
[3] Mr Huxley explained that this agreement stands in the place of the award in the following respects:
· Wage adjustments on 1 April each year
· Flexibility in the taking of RDOs
· Redundancy
· Dispute settling provision
· Meal allowance
· Fares and travelling allowance
[4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.
[5] Pursuant to s.55[4] the agreement is approved operative from 3 February 2006 and shall remain in force until 1 April 2008.
[6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
