REASONS FOR DECISION
[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (the union) and Manpower Services (Australia) Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.
[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 3 March 2006.
[3] The agreement, to be known as The Manpower Services (Australia) Pty Ltd - CEPU - Simplot Ulverstone Agreement 2005, is to be operative from the first full pay period on or after 10 February 2006 and it is to remain in force for a period of three years.
[4] The agreement applies to all current and future employees engaged to perform duties as defined in the classification structure in the Metal Engineering and Associated Industries Award 1998. At the hearing the parties agreed to amend Clause 3 - Definitions of the agreement.
[5] Oral submissions were presented by Mr K Harkins of the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia and Ms C Black representing Manpower Services (Australia) Pty Ltd.
[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; and the public interest and no disadvantage tests required by the Industrial Relations Act 1984, and I decide accordingly.
[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Industrial Relations Act 1984.
