REASONS FOR DECISION

[1] On 15 February 2006, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the General Conditions of Employment Award. The application sought to vary the standby and availability rates contained in the award to reflect safety net adjustments not incorporated in the award.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 9 March 2006. At the hearing Mr P Baker appeared for the Minister administering the State Service Act 2000 with Ms J Fitton. Mr T Kleyn appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. Mr Baker and Mr Kleyn presented oral submissions.

[3] Having heard these submissions I am satisfied that the variations are consistent with the Wage Fixing Principles and the public interest requirements of the Industrial Relations Act 1984 .

[4] The order reflecting this decision, with an operative date of 9 March 2006, is attached.
