MEANDER DAM DEVELOPMENT PROJECT ENTERPRISE AWARD

REASONS FOR DECISION

[1] These applications were lodged, pursuant to s 23 of the Industrial Relations Act 1984 (the Act), by The Australian Workers' Union, Tasmania Branch and the Construction, Forestry, Mining and Energy Union, Tasmanian Branch, respectively, to make an award to be known as Meander Dam Development Project Enterprise Award (the award).

[2] The award is established to cover all on-site civil construction work associated with the Meander Dam Project. The employees to be employed to perform in or in connection with the excavation, erection and, construction, at the project known as the Meander Dam are encompassed by the employment categories as defined in the award.

[3] The following employee organisation have an interest in the award pursuant to s.63(10) of the Act:

· the Construction, Forestry, Mining and Energy Union, Tasmanian Branch;

· The Australian Workers' Union, Tasmania Branch.

[4] The following employer organisation has an interest in the award pursuant to s.62(2) of the Act:

· the Tasmanian Chamber of Commerce and Industry Limited

[5] The following employer organisation has an interest in the award pursuant to s.62(3) of the Act:

· the Tasmanian Trades and Labor Council

[6] The award has been negotiated by the parties and is presented to the Commission by consent.

[7] I have perused the provisions found in the award and am satisfied that it is in accord with the Wage Fixing Principles and the public interest requirements of the Act.

[8] The award came into effect on and from the 15 March 2006.
