REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branch (the union) and Aquatas Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 27 February 2006, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Tuesday, 28 February 2006 at 2.45 pm.

[3] The agreement, to be known as the Aquatas (Feeders) Industrial Agreement 2006, is to be operative on and from 20 February 2006 and it is to remain in force for a period of 3 months.

[4] The agreement applies to all employees of the employer within the employer's sea-based operations and for who a classification appears in this agreement.

[5] Mr R Flanagan appeared for the union and Ms K Little for the employer.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; and the public interest and no disadvantage tests required by the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
