REASONS FOR DECISION
[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984, by the Sunlea Team Inc. (the employer), and the Health Services Union of Australia, Tasmania No. 1 Branch (the HSUA), was for the purpose of filing an industrial agreement with the Commission.
[2] Mr C Stringer appeared for the HSUA and Ms D Barnes for the employer.
[3] The agreement, to be known as the Sunlea Team Inc. (Salary Packaging and Salary Sacrifice) Industrial Agreement 2006, is operative from the first full pay period to commence on or after 8 March 2006 and shall remain in force until 28 February 2006.
[4] The objectives of the agreement are to:
-
enable the employer to convey, by agreement in writing with an employee, a component of the employee's ordinary time salary to packaged benefits and/or to salary sacrifice into a superannuation fund; and
-
attract and retain employees within the stable industrial relations framework that exists at the enterprise.
[5] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; and the public interest and no disadvantage tests required by the Act, and I decide accordingly.
