s.23 application for award or variation of award

Police Association of Tasmania
(T12715 of 2006)

POLICE AWARD

COMMISSIONER T J ABEY

HOBART, 12 July 2006

Award variation - expense related allowances - transfer expenses - defence service leave - approved - operative date ffpp 10 July 2006

REASONS FOR DECISION

[1] On 6 July 2006 an application was lodged by the Police Association of Tasmania (PAT), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Police Award.

[2] When this matter came on for hearing on 10 July 2006, Mrs A Smith appeared for the PAT and Mr T Martin appeared for the Commissioner of Police.

[3] Mrs Smith explained that the purpose of this application was to adjust expense related allowances to reflect movements in the CPI over the previous 12 months, an amount of 3 per cent.

[4] In addition changes had been made to Clause 16.4, Defence Service Leave, to reflect contemporary practice in relation to defence force training.

[5] Mr Martin indicated that the Commissioner of Police supported the application.

[6] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] The application is granted, operative from the beginning of the first pay period to commence on or after 10 July 2006.

[8] The Order reflecting this decision is attached.
