REASONS FOR DECISION

[1] On 11 July 2006, the Minister Administering the State Service Act 2000 and the Tasmanian Salaried Medical Practitioners' Society (TSMPS) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tasmanian Salaried Medical Practitioners Industrial Agreement 2006.

[2] When this matter came on for hearing on 26 July 2006, Ms K Thomas, with Ms J Cox, appeared for the Minister. Dr H Perndt, with Dr K Daniels, appeared for the TSMPS.

[3] Ms Thomas explained that the major departure from previous agreements concerned the adoption of a formal nexus arrangement with interstate counterpart agreements. This involved the concept of a national average base salary rate, which is to be compared with the Tasmanian position on an annual basis.

[4] Other matters addressed in the agreement include:

· Expense related allowances
· Call back provisions
· Non salary benefits
· Professional development leave

[5] Dr Perndt said that he was confident that the agreement would assist in creating an attractive package which would impact positively on attraction/retention issues.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and does not disadvantage the employees concerned.

[7] Pursuant to s.55(4) of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 1 July 2006 and shall remain in force until 1 July 2009.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
