REASONS FOR DECISION

[1] On 23 August 2006, an application was lodged by the Community and Public Sector Union (State Public Services Federation Tasmania) Inc., pursuant to s.23 of the Industrial Relations Act 1984, to vary the General Conditions of Employment Award and the Community and Health Services (Public Sector) Award.

[2] The application sought to vary expenses related allowances.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Tuesday 29 August 2006 at 9.30 am.

[4] At the hearing Mr M Johnston appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. Mr P Baker appeared for the Minister administering the State Service Act 2000. The parties requested that the matters be joined.

[5] Mr Johnston gave oral submissions in support of the claim. Following off-the-record discussions between the parties, the applications were varied to include a 2.98% increase, applying the formula established by the Full Bench in T833 of 1987. The matters were set down for further discussion between the parties, who will report back to the Commission.

[6] The parties agreed that, in the interim, expense related allowances in the awards will be increased by 2.98% with an operative date of 30 August 2006. I have decided to grant the agreed increases. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[7] The Orders giving effect to this Decision are attached.

[8] The files will remain open.
