REASONS FOR DECISION

[1] On 28 August 2006, an application was lodged by the Tasmanian Trades and Labor Council (TTLC), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Tasmanian Information Technology Award.

[2] The application sought to vary Clause 5 - Salary Rates of Part III - Salaries and Related Matters.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 6 September 2006 at the Commonwealth Law Courts, 39-41 Davey Street, Hobart. At the hearing Mr D Pyrke of the Association of Professional Engineers, Scientists and Managers, Australia appeared for the TTLC with Mr L Crowley. Mrs S Haas appeared for the Tasmanian Chamber of Commerce and Industry Limited

[4] Mr Pyrke and Mrs Haas gave oral submissions in support of the application. Having considered these submissions, I am satisfied that the variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[5] The order reflecting this decision, with an operative date of 6 September 2006, is attached.
