Award variation - expense related allowances - meal allowance - applications approved - operative date ffpp 18/9/06

REASONS FOR DECISION

[1] On 11 September 2006, applications were lodged by the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Building Trades Award, the Building and Construction Industry Award and the Mobile Crane Hire Award.

[2] When these matters came on for hearing on 18 September 2006, Mr A Benson appeared for the CFMEU. Mrs S Haas appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[3] Mr Benson explained that these applications sought to vary expense related allowances to reflect movements in the relevant CPI index between the June quarter 2005 and the June quarter 2006.

[4] Mrs Haas advised that the TCCI consented to the application.

[5] I am satisfied that the applications are consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] The applications are granted operative from the beginning of the first pay period to commence on or after 18 September 2006.

[7] The Orders reflecting this decision are attached.
