REASONS FOR DECISION

[1] On 24 October 2006, an application was lodged by the Minister Administering the State Service Act 2000, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the AWU (Tasmanian State Sector) Award.

[2] When this matter came on for hearing on 2 November 2006, Mr P Baker, with Ms J Fitton, appeared for the Minister. Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch.

[3] This application seeks to delete Appendix A - AWU (Tasmanian State Sector) Training Wage Agreement.

[4] Mr Baker explained that this application was a consequence of the making of the Tasmanian State Service National Training Wage Award by McAlpine C on 24 October 2006.1

[5] Mr Flanagan advised that whilst the AWU intended to maintain discrete award coverage for AWU members employed in the State sector, the union was sympathetic to the position advanced by Mr Baker. The application was not opposed.

[6] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. The application is granted operative from 2 November 2006.

[7] The Order reflecting this decision is attached.
