TASMANIAN INDUSTRIAL COMMISSION

Industrial Relations Act 1984
s.23 application for award or variation of award

The Australian Workers' Union, Tasmania Branch
(T12835 of 2006)

AWU (TASMANIAN STATE SECTOR) AWARD

COMMISSIONER T J ABEY

HOBART, 15 November 2006

Award variation - expense related allowances - application approved - operative dates ffpp 1 August 2006 and ffpp 13 August 2006

REASONS FOR DECISION

[1] On 3 November 2006 an application was lodged by The Australian Workers' Union, Tasmania Branch (AWU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the AWU (Tasmanian State Sector) Award.

[2] When this matter came on for hearing on 13 November 2006, Mr R Flanagan appeared for the AWU; Mr P Baker appeared for the Minister.

[3] Mr Flanagan explained that the purpose of the application was to adjust allowances in line with or in accordance with the methodology used for allowances in the General Conditions of Employment Award. As a consequence allowances are adjusted by 2.98% to reflect the movement in the CPI for the 12 months preceding March 2006.

[4] Mr Baker consented to the application.

[5] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] The application is granted operative from the beginning of the first pay period to commence on or after 1 August 2006 and 13 August 2006.

[7] The Order reflecting this decision is attached.
