Award variation - Part III - Wage Rates and Related Matters - Clause 1 - Wage Rates - amend subclause (a) - consent application - application approved - operative date 1 October 2006 REASONS FOR DECISION [1] This is an application pursuant to s.23 of the Industrial Relations Act 1984, made by the Health Services Union of Australia, Tasmania No. 1 Branch and lodged on 22 November 2006. [2] The application sought to vary the Community Services Award (the award), by amending at Part III - Wage Rates and Related Matters, Clause 1 - Wage Rates, subclause (a). [3] Mr T Kleyn entered an appearance for the Health Services Union of Australia, Tasmania No. 1 Branch; Mr M Swanton for the Australian Municipal, Administrative, Clerical and Services Union; and Ms S Haas for the Tasmanian Chamber of Commerce and Industry Limited. [4] Having heard the submissions from the parties, I am satisfied that the award should be varied in the manner set out in the draft order attached to the application. In approving the application, I am satisfied it is not contrary to the public interest test required pursuant to s.36 of the Act, is consistent with the Wage Fixing Principles and, I decide accordingly. [5] The Order giving effect to this decision is attached and will be operative from 1 October 2006.
