Award variation - school based apprenticeships - application approved - operative date ffpp 21 December 2006 REASONS FOR DECISION [1] On 8 December 2006, an application was lodged by the Minister administering the State Service Act 2000, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Operational Employees Award. [2] When this matter came on for hearing on 21 December 2006, Mr P Baker appeared for the Minister. Mr T Kleyn appeared for the Health Services Union of Australia, Tasmania No. 1 Branch. [3] Mr Baker explained that the purpose of this application was two-fold. [4] Firstly, it sought to introduce provision for school based apprenticeships, consistent with a recent variation in the National Training Wage (Private Sector) Award. [5] Secondly, the application sought to vary the payment arrangements by replacing time based criteria with competency based provisions. [6] Mr Kleyn indicated his union's support for the application. [7] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [8] The application is granted operative from the beginning of the first pay period to commence on or after 21 December 2006. [9] The Order reflecting this decision is attached.
