Award interest - interest granted - operative date 25 May 2006 - award varied - forwarded to Registrar REASONS FOR DECISION [1] This is an application by the Civil Contractors Federation - Tasmanian Branch, lodged pursuant to s.65A of the Industrial Relations Act 1984, seeking a determination of "Interest" in the above awards. The President has referred the application, pursuant to Section 65A(2), to myself for hearing and determination and, if necessary, subsequent award variation. The application was set down for hearing on 25 May 2006. [2] Appearances: Mr A Granger and Miss E Frankow for Civil Contractors Federation - Tasmanian Branch. Mr R Flanagan for the The Australian Workers' Union, Tasmania Branch and, with written authority, for the Construction, Forestry, Mining and Energy Union, Tasmanian Branch. [3] Correspondence had been received from the TCCI indicating that the application was not opposed provided the requirements of the Act were met. [4] Mr Granger spoke to his application, which in turn was supported by Mr Flanagan. [5] Having heard the parties I am satisfied that: · The membership of the Federation includes employers that are engaged in the industry and occupations to which the awards relate; · The membership is consistent with the organisation's rules; · The granting of the application would not prejudice the orderly conduct of industrial relations in Tasmania. [6] Pursuant to s.63[10][c] of the Act the application for award interest is granted with effect from 25 May 2006. [7] A copy of this determination will be forwarded to the registrar in accordance with s.63[12] of the Act. [8] The orders reflecting this decision are attached.
