Minister administering the State Service Act 2000
(T12864 of 2006)

TASMANIAN STATE SERVICE NATIONAL TRAINING WAGE AWARD

COMMISSIONER JP McALPINE

HOBART, 3 January 2007

Award variation - School Based Traineeships - consent application - application approved - operative date ffpp 3 January 2007

REASONS FOR DECISION

[1] This application was lodged, pursuant to s 23 of the Industrial Relations Act 1984, by the Minister administering the State Service Act 2000 (the Minister), to vary the Tasmanian State Service National Training Wage Award (the award).

[2] When this matter came on for hearing on 3 January 2007, Mr P Baker appeared for the Minister; and Mr T Jacobson for the Health Services Union of Australia, Tasmania No. 1 Branch.

[3] Having heard the submissions of the parties, I am satisfied that the award should be varied by replacing paragraphs (i), (ii), (iii), (iv) and (v) at Clause 12(c) - School Based Traineeship with the following paragraph:

"In the event that the normal full time weekly hours are not 38 the appropriate weekly rate shall be obtained by multiplying the hourly rate in the table by the normal full time hours."

[4] In approving the application, I am satisfied it is consistent with both the Wage Fixing Principles and the public interest test required pursuant to s.36 of the Act.

[5] The consolidation of the award reflecting this variation is attached and will take effect from the first full pay period to commence on or after 3 January 2007.
