Award variation - Part V(3)(a) - bushfire fighting (retention of classification) - consent matter - application granted - award varied - operative date ffpp 22 January 2007 REASONS FOR DECISION [1] On 15 January 2007, an application was lodged by The Australian Workers' Union, Tasmania Branch, pursuant to s.23 of the Industrial Relations Act 1984, to vary the AWU (Tasmanian State Sector) Award. [2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Monday January 22. At the hearing Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch. Mr P Baker appeared for the Minister administering the State Service Act 2000. [3] Mr Flanagan explained that the purpose of this application was to clarify the intent of the award in circumstances whereby a Works Crew employee acted up as a section leader during fire fighting operations. [4] Mr Baker consented to the application. [5] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [6] The application is granted and the award is varied operative from the beginning of the first pay period to commence on or after 22 January 2007. [7] The order reflecting this decision is attached.
