COMMISSIONER JP McALPINE

HOBART, 13 March 2007

Award variation - application amended - conditions: school-based apprenticeships - application granted - operative date 9 November 2006

REASONS FOR DECISION

[1] On 1 March 2007, an application, as amended, was lodged by the Tasmanian Chamber of Commerce and Industry Limited (TCCI), pursuant to s.23 of the Industrial Relations Act 1984, to vary the National Training Wage (Tasmanian Private Sector) Award.

[2] When this matter came on for hearing on 13 March 2007, Mr D Hodgson appeared for the TCCI and Mr P Aiken for the Health Services Union of Australia.

[3] Having heard the submissions from the parties, I am satisfied that the award should be varied in the manner set out in the amended draft order. In approving the application, I am satisfied it is consistent with both the Wage Fixing Principles and the public interest test required pursuant to s.36 of the Act.

[4] The application is granted operative from 9 November 2006.

[5] The Order reflecting this decision is attached.
