TASMANIAN FIRE FIGHTING INDUSTRY EMPLOYEES AWARD

REASONS FOR DECISION

[1] This is an application pursuant to s 23 of the Industrial Relations Act 1984 (the Act) by the United Firefighters Union of Tasmania to make an award to be known as the Tasmanian Fire Fighting Industry Employees Award (the award).

[2] The following employee organisation has an interest in the award pursuant to s.63(10) of the Act.

United Firefighters Union of Tasmania

[3] The following employer has an interest in the award pursuant to s.62(4) of the Act.

The Minister administering the State Service Act 2000.

[4] The parties were previously subject to the jurisdiction of the Australian Industrial Relations Commission (AIRC). They have agreed to vacate that jurisdiction and any relevant awards and agreements made in the AIRC have been set aside.

[5] Accordingly the award, the subject of this decision, reflects the terms and conditions found in the former AIRC award subject to some necessary consequential variations in respect to the "formatting of certain legislative requirements in relation to discrimination etc."

[6] The award satisfies the wage fixing principles of this Commission and in particular meets the requirements of the recently amended principle 13 which provides for a public sector award to reflect total rates of pay, including rates found in an agreement. It is noted that the rates in the award are those negotiated by the parties and are not subject to determination by reference to the work value principle.

[7] I am satisfied that the award it is in accord with the Wage Fixing Principles and the public interest requirements of the Act.

[8] The award came into effect from the first full pay period to commence on or after 30 May 2007.
