REASONS FOR DECISION

[1] On 8 June 2007, the Minister administering the State Service Act 2000 and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Department of Police and Emergency Management Forensic Scientists Industrial Agreement 2007.

[2] When this matter came on for hearing on 14 June 2007, Mr F Ogle, together with Mr S Wilson-Haffenden and Mr T Crawford, appeared for the Minister. Mr M Johnston appeared for the CPSU.

[3] This agreement arose out of a decision in T12631 of 2006 referred to as the Allied Health Professionals Inclusion case.

[4] Both parties acknowledged that whilst the agreement had linkages to the Tasmanian Public Sector Allied Health Professionals Industrial Agreement 20051, including the nexus arrangement, it had been specifically tailored to meet the needs and circumstances of the FSST. This was particularly so insofar as the classification structure and descriptors were concerned.

[5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and does not disadvantage the employees concerned.

[6] Pursuant to s55(4) of the Act, the agreement is approved operative from 14 June 2007 and shall remain in force until 30 September 2008.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
