Industrial agreement - application approved - operative date 3/12/07 - forwarded to Registrar for registration REASONS FOR DECISION [1] On 22 November 2007, the Speaker of the House of Assembly and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the House of Assembly Staff Industrial Agreement 2007. [2] On 26 November 2007, the President of the Legislative Council and the Speaker of the House of Assembly and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Legislature-General Staff Industrial Agreement 2007. [3] On 26 November 2007, the President of the Legislative Council and The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Legislative Council Staff Industrial Agreement 2007. [4] When these matters came on for hearing on 3 December 2007, Mr S Donnelly appeared for the Speaker of the House of Assembly in matter T13049, Mrs S McLeod appeared for the President of the Legislative Council and the Speaker of the House of Assembly in matter T13051, and Mr D Pearce appeared for the President of the Legislative Council in matter T13052. Mr M Di Pretoro appeared for the CPSU. [5] Mr Donnelly advised that the three discrete agreements were a consequence of the staff of the Parliament not covered by the State Service Act 2000. [6] He said that the purpose of the proposed agreements was to incorporate the State Service Wages Agreement, specifically the 4.5% salary adjustment, to apply from beginning of the first pay period to commence on or after 1 December 2007. [7] Mr Donnelly was supported by Mrs McLeod, Mr Pearce and Mr Di Pretoro. [8] I am satisfied that the agreements are consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and do not disadvantage the employees concerned. [9] Pursuant to s55(4) of the Industrial Relations Act 1984, the agreements are approved operative from 3 December 2007 and shall remain in force until 31 December 2007. [10] The files will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
