Award variation - variation to salaries for apprentices - addition of adult apprentice provisions - extension of range of qualifications - insertion of relevant qualifications from national framework - consent application - operative date ffpp 1 December 2007

REASONS FOR DECISION

[1] On 26 November 2007, an application was lodged by the Minister administering the State Service Act 2000, pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Operational Employees Award.

[2] When this matter came on for hearing on 5 December 2007, Mr P Baker, with Ms J Fitton, appeared for the Minister. Ms C Serra appeared for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc.

[3] Mr Baker explained that this application was the second part of an ongoing process arising from 2006 COAG initiatives in relation to competency-based training for apprentices.

[4] The application provides for apprenticeships at Certificate Level 111, IV and V with appropriate exit points.

[5] The application recognises the growing trend for students to remain at school until the completion of years 11 and 12 and provides for the first time for adult apprentices.

[6] Mr Baker expressed confidence that this variation will open up improved opportunities for the employment of apprentices into the future.

[7] Ms Serra supported the application.

[8] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[9] The application is granted operative from the beginning of the first pay period to commence on or after 1 December 2007.

[10] The order reflecting this decision will follow in the form of a consolidated award.
