REASONS FOR DECISION

[1] On 4 April 2007, an application was lodged by the Minister administering the State Service Act 2000, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Tourism Tasmania Award. The application sought to delete the definition "Term Appointment" from Clause 7 - Definitions and to delete Annexure A.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on Wednesday 5 December 2007 at 9.30 am.

[3] At the hearing Mr P Baker appeared for the Minister administering the State Service Act 2000. Ms K Tyson appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. After some preliminary discussion the parties agreed to report back to the Commission on Thursday 13 December 2007 at 10.00am. On this date both Mr Baker and Ms Tyson gave oral submissions in support of the application.

[4] I am satisfied that the variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[5] The order reflecting this decision, with an operative date from 13 December 2007, is attached.
