REASONS FOR DECISION

[1] On 3 December 2007, an application was lodged by the Minister administering the State Service Act 2000 (MASSA), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Community and Health Services (Public Sector) Award. The application sought to insert a new Parental Leave clause consistent with the decision of the Tasmanian Industrial Commission in T12444 of 2006.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on Friday 7 December 2007 at 9.30 am. At the hearing Mr P Baker appeared for MASSA. Mr T Jacobson appeared for Health Services Union of Australia, Tasmania No. 1 Branch and for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. Mr D Pyrke appeared for the Association of Professional Engineers, Scientists and Managers, Australia

[3] All of the above gave oral submissions in support of the application.

[4] I am satisfied that the variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[5] The order reflecting this decision, with an operative date from 1 January 2008, is attached.
