Award variation - application amended - parental and bereavement leave - consent application - application approved - operative date 4 January 2008 REASONS FOR DECISION [1] This application was lodged, pursuant to s 23 of the Industrial Relations Act 1984, by the Minister administering the State Service Act 2000 (the Minister), to vary the Nurses (Tasmanian Public Sector) Award 2005 (the award). [2] When this matter came on for hearing on 4 January 2008, Ms J Fitton and Ms J Cox appeared for the Minister; Ms N Ellis with Ms A Stanislaus-Large for the Australian Nursing Federation Tasmanian Branch (ANF); and Mr T Jacobson for the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA). [3] At the commencement of the hearing Ms Fitton sought and was granted leave to amend the application. The parties advised that the ANF and the HSUA consented to the amendment. [4] Having heard the submissions of the parties, I am satisfied that the award should be varied by deleting from Part VI - Leave and Holidays With Pay, Clause 5 - Bereavement Leave and Clause 7 - Parental Leave and inserting new clauses as outlined in the consent draft Orders (Exhibits M.1 and M.2). [5] In approving the application, I am satisfied it is consistent with both the Wage Fixing Principles and the public interest test required pursuant to s.36 of the Act. [6] The consolidation of the award reflecting this variation is attached and will take effect on and from 4 January 2008.
