REASONS FOR DECISION

[1] This is an application pursuant to s 23 of the Industrial Relations Act 1984 (the Act) by the Minister Administering the State Service Act 2000 (the Minister) to vary the Teaching Service (Tasmanian Public Sector) Award (the award).

[2] When this matter came on for hearing on 22 January 2008, Mr M Watson and Ms S Haas appeared for the Minister; Mr C Lane for the Australian Education Union, Tasmanian Branch (the AEU).

[3] During the course of the hearing Mr Watson sought and was granted leave to amend the application. Mr Lane advised that the AEU consented to the amendment.

[4] Having heard the submissions of the parties, I am satisfied that the award should be varied as outlined in the consent draft Order (as amended).

[5] In approving the application, I am satisfied it is consistent with both the Wage Fixing Principles and the public interest test required pursuant to s.36 of the Act.

[6] The consolidation of the award reflecting the variations is attached and will take effect from the various dates as set out in Part I - Application and Operation of the Award, Clause 4 - Date of Operation.
