THE DEPARTMENT OF INFRASTRUCTURE, ENERGY AND RESOURCES (DIER), ROADS & TRAFFIC ENGINEERS INDUSTRIAL AGREEMENT 2008

REASONS FOR DECISION 

 

[1] On 20 March 2008, the Minister administering the State Service Act 2000 and The Association of Professional Engineers, Scientists and Managers, Australia lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The Department of Infrastructure, Energy and Resources (DIER), Roads & Traffic Engineers Industrial Agreement 2008. 

[2] When this matter came on for hearing on 27 March 2008, Ms J Fitton, Mrs B Beltz and Ms J Pearson appeared for the Minister. Mr D Pyrke appeared for the Union. 

[3] Mrs Beltz explained that this agreement introduced a number of important innovations including a competency based career structure framework and a tailored performance management system. 

[4] The agreement provides for the following salary adjustments: 

- 5% from 30 March 2008

- 3.5% from 30 March 2009

- 3.5% from 30 March 2011

[5] A Market Allowance of 5% will take effect from 30 March 2008 with a market review to be undertaken prior to 30 March 2010.

[6] Mr Pyrke endorsed the submissions of Mrs Beltz and noted in particular that the agreement provided a career structure for project managers. He said there had been wide consultation and the agreement was endorsed by the membership. 

[7] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and does not disadvantage the employees concerned. 

[8] Pursuant to s55(4) of the Act, the agreement is approved operative from 30 March 2008 and shall remain in force for a period of four years. 

[9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
