Industrial Agreement - agreement approved - operative 6 May 2008 – to remain in force for a period of 3 years - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch and the Tasmanian Union of Professional and Clerical Officers in Education, was for the purpose of filing an industrial agreement with the Commission.

[2] On 23 April 2008, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania to commence on Tuesday, 6 May 2008 at 9.10 am.

[3] The agreement, to be known as the AEU Tasmanian Branch Employees Agreement 2008, is to be operative on and from 6 May 2008 and it is to remain in force for a period of 3 years.

[5] Mr C Lane for the Australian Education Union, Tasmanian Branch and Mr D Wishart for the Tasmanian Union of Professional and Clerical Officers in Education, presented submissions in support of the consent application.

[6] Having considered the consent submissions of the parties, I am satisfied the agreement is consistent with: the Wage Fixing Principles; the public interest and no disadvantage tests required by the Act; and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
