Industrial agreement – agreement approved – operative 1/4/08 – to remain in force until 31/3/09 – forwarded to the registrar for registration

 REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 (the Act) by Health Services Union of Australia, Tasmania No. 1 Branch (the union) and North West Residential Support Services Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Edward Braddon Commonwealth Law Courts Building, 39-41 Davey Street, Hobart on Friday 6 June 2008.

[3] The agreement, to be known as North West Residential Support Service Inc. Industrial Agreement 2008, is to be operative on and from 1 April 2008 and it is to remain in force until 31 March 2009.

[4] The agreement applies to all employees of North West Residential Support Services Inc. in respect of the employment by the employer of employees providing Residential Support Level 3, Tenancy Support and Tenancy Support specific to MAIB requirements.

[5] Ms M Jamieson appeared for the union and Mr J O’Neill for the employer.

[6] Having considered the consent submission of the parties, I am satisfied that the agreement is consistent with the Wage Fixing Principles and the public interest and no disadvantage tests required by the Act and I decide accordingly.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
