Award variation – Change of Name from the Tasmanian Catholic Education Employees’ Association to the Independent Education Union of Australia, Tasmania - application granted – award varied – operative date 30 May 2008

REASONS FOR DECISION

[1] This is an application pursuant to s.23 of the Industrial Relations Act 1984 (the Act), made by the Independent Education Union of Australia, Tasmania (the union) and lodged on 19 May 2008.

[2] The application sought to vary the Catholic Education Award, and in particular the change of name of the registered organisation Tasmanian Catholic Education Employees’ Association to the Independent Education Union of Australia, Tasmania at Clause 5 – Award Interest and Clause 7 – Definitions.

[3] Hearings were held at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 27 and 30 May 2008.

[4] At the hearing Ms A Briant appeared for the union.

[5] Having heard the submissions from the union, I am satisfied that the Catholic Education Award should be varied in the manner set out in the above application. In approving the application, I am also satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act

[6] The Order giving effect to this decision is attached and will be operative on and from 30 May 2008.
